The Future is Now

I heard an interesting term the other day. A friend was discussing the book she’s reading for her book club, and she referred to it as a “pBook.”
I was initially mystified.
Turns out a “pBook,” as she explained, is a book in print form. Or, as I like to refer to it, a book.

But is this the wave of the future? As eBooks become more prevalent, will the term “pBook” enter our lexicon?

Recently Andrew Gross announced that for his latest release, RECKLESS, a full 35% of his sales were digital downloads. I noticed that he made the long list for New York Times bestsellers, and it made me wonder. Do digital sales count toward the list now? I’d love an answer if anyone knows.

Regardless, 35% is simply remarkable, considering what a leap that likely is from previous years. I know that in the past, my books averaged between 5-10%. I’m currently awaiting my most recent royalty statement, and I wonder what kind of increase I’ll see for my titles.

The eRights Grab

So to end the year, I thought I’d close with yet another issue confronting the publishing industry: eBook rights. Ten years ago, these were rarely included in contracts, since the prospect of reading books in this format was still fairly far off on the horizon.

But we’re about to enter a whole new decade, by the end of which I suspect at least half of all books will be enjoyed on some form of eReader (and that’s a conservative estimate). Which makes the move by Random House last week pertinent to all of us, especially authors who have backlist books where eRights weren’t spelled out.
Here’s what happened, as detailed by the Author’s Guild:

“On Friday, Random House CEO Markus Dohle sent a two-page letter to many literary agents regarding e-books. Much of the letter is devoted to Random House’s efforts and investments to market traditional and electronic books.

On the second page, Mr. Dohle gets to the point. After noting that most of Random House’s backlist titles grant the publisher electronic book rights (we agree, since most backlist titles are from the past ten years, a period in which authors have generally licensed electronic rights in tandem with their print rights), he writes that “there have been some misunderstandings concerning ebook rights in older backlist titles.” He then proceeds to argue that older contracts granting rights to publish “in book form” or “in all editions” grant electronic rights to Random House.

The misunderstandings reside entirely with Random House. Random House quite famously changed its standard contract to include e-book rights in 1994. (We remember it well — Random House tried to secure these rights for royalties of 5% of net proceeds, a pittance. We called it a “Land Grab on the Electronic Frontier” in our press release headline.) Random House felt the need to change its contract, quite plainly, because its authors did not grant those rights to it under Random House’s standard contracts prior to 1994.

A fundamental principle of book contracts is that the grant of rights is limited. Publishers acquire only the rights that they bargain for; authors retain rights they have not expressly granted to publishers. E-book rights, under older book contracts, were retained by the authors.

There’s no need to take our word for this, however. A federal court in 2001 examined this precise matter in Random House v. Rosetta Books. Judge Stein of the Southern District of New York was unequivocal in his 10-page decision: authors did not grant publishers the e-book rights in the old book contracts at issue. Judge Stein specifically dismissed notions, raised by Mr. Dohle in his letter to agents, that the non-compete clauses of these old contracts in some manner acted to grant Random House electronic rights to the works, saying that this “reasoning turns the analysis on its head.” The court pointed out that the license of rights comes solely from the contract’s grant language, not from the non-compete clause, and that non-competition clauses, to be enforceable, have to be narrowly construed. Using the non-compete clause to secure future rights is unsustainable. An appellate court affirmed Judge Stein’s decision.

We are sympathetic with the difficult position the publishing industry is in at the moment. The recession has been tough on book publishing, as it has been on many industries. And everyone with knowledge of the dynamics of the industry properly fears that Amazon’s dominance of the online markets for traditional and especially e-books will give it a chokehold on industry profits. Difficult times, however, do not justify this attempt at a retroactive rights grab.

It’s regrettable and unhelpful that Random House has chosen to try to intimidate authors and agents over these old book contracts. With such a weak legal hand, it would be well advised to stick to its strength — the advantages that its marketing muscle can provide owners of e-book rights. It should also start offering a fair royalty for those rights. Authors and publishers have traditionally split the proceeds from book sales. Most sublicenses, for example, provide for a 50/50 split of proceeds, and the standard trade book royalty of 15% of the hardcover retail price, back in the days that industry standard was established, represented about 50% of the net proceeds of the sale of the book. We’re confident that the current practice of paying 25% of net on e-books will not, in the long run, prevail. Savvy agents are well aware of this. The only reason e-book royalty rates are so low right now is that so little attention has been paid to them: sales were simply too low to scrap over. That’s beginning to change.

If you have an old book contract in which you haven’t granted e-book rights, patience is likely to pay off. The e-book industry is still young — there’s no need to jump in. And we strongly suspect e-royalty rates are at a low-water mark.”

I feel the same way- can a publisher really justify a 75/25 split when the costs involved with bringing an eBook to market are dramatically less than those incurred by a mass market paperback? The fact that initially 5% was offered is almost laughable- clearly someone saw the writing on the wall. The question is, with the entire market beginning to shift in this direction, how can authors protect themselves? How do you prevent your backlist from being exploited? Since eBooks tend to retail for $5-$15, a more equitable distribution of the royalties means that even with this seismic shift, writers could still manage to earn a living from their work.

It’ll be interesting to see how this issue in particular shakes out. No matter what, I think that despite all the doom and gloom, this is an exciting time to be involved in the publishing industry. The world is changing rapidly, and the publishing industry is now being dragged into the modern millenium. It’s impossible to foresee exactly what the future will bring, but no matter what, the times they are a changin’.

The E-reader Tsunami Is Coming

We’ve had a few previous discussions about e-books and the electronic devices on which you can read them. Why another post on the subject? Because unlike in the past, things are about to get really serious. So if you’re thinking about investing in a reader such as the Amazon Kindle 2, you might want to hold off for a short while because there’s a whole new generation of  readers about to hit the shelves.

A number of companies such as Asus, Plastic Logic, and the sony-readerBritish company Interead are ready to launch new devices that will get you reading digitized books and newspapers at prices that are finally becoming reasonable, some starting as low as $165. Sony is already shipping their e-reader starting at $199 (pictured). On October 20, Barnes & Noble introduced their e-reader called the Nook ($259).

Major publishers are jumping into the e-book pool on sites like SCRIBD while thousands of books are being converted into Kindle format and made available on Amazon every day. If nothing else, the term “out of print” will soon disappear from our vocabulary.

There is a downside to the plethora of new e-readers: format compatibility. An example is the books and periodical subscriptions your purchase through Amazon may not be readable on a different brand other than Kindle.

kindle2 Also, keep an eye on Google in all this. They want to scan millions of out-of-print books and make them available through the Google Book Search for e-book readers. Amazon is fighting this because Google’s deal makes it hard for other e-book sellers (such as Amazon) to scan and distribute these same books. I bet this battle gets dirty before the dust settles.

But the tsunami of new e-readers should mean that we’ll see the end of Amazon’s only-game-in-town Kindle dominance as the prices go down and the features go up. Remember the Apple iPhone a few years ago and what happened next?

Sony introduces potential Kindle killer

Ah, the life of an international best-selling thriller author… Meanwhile, I’m here in dank, sweltering Manhattan, pounding away on my keyboard, like a bad parody of Mickey Spillane. But who said life is fair?

panic-attackWith a new book, PANIC ATTACK, out I’ve had marketing on my mind lately, and I think this week may turn out to be a key moment in book publishing history. Okay, maybe I’m exaggerating…a lot…but I think the announcement of Sony’s new Daily Edition reader is really going to shake up the electronic publishing landscape, and maybe the entire publishing landscape.

The Daily Edition is a far cry from Sony’s old reader, which wasn’t as sleek at the Kindle and couldn’t download content wirelessly. Early reviews say the Daily Edition is a potential Kindle killer as it does one big thing the Kindle can’t (and won’t) do–it lets readers download books for free. That’s right, via their local libraries, customers will be able to take e-books out on loan for two or three weeks for no charge.

With so much free content available, how will publishers and Amazon be able to charge full price for books? For example, if Michelle, on her exotic beach vacation, wants to read a copy of James Patterson’s latest, where is her incentive to buy the e-edition of the book when she can download it (and as many other books as she wants) for free? Will publishers have to change the way they sell books to libraries, and alter the prices of their e-books? It’s hard to imagine that if readers have a free option for e-books that they will continue to shell out the 10 dollars or more that Amazon is currently charging for new hardcover titles.

image Daily Edition also allows for other booksellers to distribute their content onto the device. This could be a great chance for Indy booksellers to get into the e-books game, but it could also create even more price competition.

But the main question about e-readers remains–are these devices here to stay and are books as we know them on life support? A little disclosure here. Late last year, I received a Kindle 2 as a gift. When I’m traveling and commuting it’s amazing. The ability to send Word files to my Kindle is a God’s send for reading manuscripts on the go. Lately, though, I find when I’m home and want something to read I go for an old fashioned book. I guess I feel like I look at a computer screen all day long, and when I want to relax I don’t want to hold a gadget, no matter how easy the screen is on the eyes. So, while a few months ago, I was telling people e-books are the wave of the future, I’m not so sure anymore. I see e-books becoming mainly for travel and commuting, and the regular book sticking around for every other use.

As an author, though, I’m excited about the potential proliferation of e-readers because they create the possibility of infinite book sales and could potentially make "book distribution" obsolete. For example, if The Today Show calls tomorrow and wants me on to discuss PANIC ATTACK, my publisher would have to reprint to satisfy the sudden demand. By the time the books arrived in stores, the demand would no longer exist. But in a world where everyone on the planet has an e-reader, a big national media appearance could generate tens of thousands of sales instantly.

So what do y’all think about all this? How are publishers going to price their books in a landscape where Sony is going to effectively start giving away many titles for free? Are you authors out there embracing e-books or would you rather they disappeared?

How “green” is your book?

How green is your book, Dracula?

Earlier this week Michelle Gagnon blogged about Internet promotion for authors. The fact that I’m guest blogging here today is a good illustration of another common type of internet promo: authors popping in on one another’s blogs to “meet” new readers. The fact that I’m mentioning this supports another of her very good points: that it’s a small world in the author community. I know two of the bloggers here at The Kill Zone–Kathryn Lilley invited me here today. (Nonetheless, I’m using Michelle’s name at the top of my blog because I’ve seen her shoot a Glock. Okay, it was at a gun range for a Sisters In Crime event, but still. Girl’s got aim.)

I am spending my promotional time guest blogging rather than Twittering (not that an author can’t do that simultaneously) or updating my MySpace and Facebook pages because I hate doing those things. Hold on did I type that out loud? Ahem. What I meant to write is that I’m a Go Green/Read-E (book) ambassador. Which means I’m blogging to help promote ebooks as an eco-conscious alternative to the traditional paper book format.

Being green is important. Especially if, like me, you live in the sort of city where if you forget to bring your own, reusable, organic ink, fair trade, recycled material grocery bags to the supermarket, the collective laser beam of guilt focused on you is so awful you find yourself buying a fresh new set of reusable bags. To add to the pile you have at home big enough to form into a meditation yurt in the backyard.

However, as I researched things like how many trees a reader would save if he/she read 20 books and two newspapers electronically (one tree a year, which adds up to a lot of forests given all the readers in the world) I ran across a study that had already done this. Fortunately, my native eco-sensitivity awarded me plenty of time to ponder what else I could blog about. I thought long and hard during my eighteen trips back and forth from car to kitchen to unload groceries. (“You’re out of reusable grocery bags? Someone’s been buying them all up? Who would do that? Of course I don’t want plastic ones. Just load everything back to the cart.”) And what I realized, during a break on trip ten to protect the Chunky Monkey by carefully siphoning off the melty bits with a soup spoon, what I really should be assessing is my own contribution to global warming. Forget the paper versus electronic publishing format debate. What about the book itself?

As an eco-conscious paranormal mystery writer, what I need to know is this: Are vampires bad for the environment?

Think about it. Unless they have the bad fortune to collide chest first with a sharp stake or (in my books) step out into a lovely, sunny, existence-ending day, they live forever. Longer than Styrofoam. Or Twinkies. Or broccoli on my niece’s plate (unless I happen to look away, in which case the stalks magically disappear in a puff of air that curiously also makes the light fixtures above the table swing…).

It seems pretty obvious Vampires take up more than their fair share of resources, don’t you think?

Well…

On the plus side, and this is a big plus they don’t eat human food. And if you ever read the statistics about what’s trashing our environment, the resources we use to grow food are a big part. There’s methane from cattle (a discreet way of saying cow farts) polluting our air, fertilizer polluting our streams, etc. etc. Major eco points for Dracula!

Also on the plus side, the undead don’t commute. Not in cars anyways. Granted any vampire worth his sex symbol status will own a nice set of wheels, but it’s not as if he’s stuck in rush-hour traffic every day. No vampire with the least bit of brains would spend an hour or two a day battling road rage on the freeway when he could just turn into a bat and fly where he needs to go. (I assume any technology that would allow him to drive a car during daylight hours could also be used to protect his batty little wings. Excuse me. Very sexy, uber-masculine man-vamp wings.)

This is sounding pretty good for a vampire’s carbon footprint, except for the fact that for most vampires, one person equals one meal. Tsk. Tsk. Really, vampires of the world, do you have any idea how much it takes to get a pretty young maiden to eighteen in this country? In purely financial terms, estimates range from $38,027 to $104,532. Do you know how many McDonald’s Happy Meals the average eighteen year old has eaten? I don’t, but I imagine it’s a lot. Let’s face it, puberty, is one long Fry Emergency. In cow farts alone, the cost of producing one young maiden must be astronomical. No wonder cow methane is such a big pollutant!

Clearly, vampires need to get on board with the eco message of Reduce, Reuse, Recycle. I know it will be hard–like telling a writer to lay off the chocolate near a deadline. But it’s important! Everyone must do their part. Including readers, especially, it seems, those who like vampire stories. Why not do your part to help the planet and make you next book an ebook!

Kindle 2.0

We’ve discussed the Kindle e-book reader a number of times here in the past. Even though its market penetration is still modest at best, I think everyone admits it is or will be a factor in the future of publishing. So with 230,000 titles (including mine) available for downloading onto the Kindle, it’s probably worth discussing again now that the product has some significant upgrades.

Recently, Amazon introduced the new Kindle 2. Some of the features in the updated version are a battery kindle2 that will last two weeks, more contrast on the black-and-white screen than the previous version, faster wi-fi connections, more memory, a smaller size that weighs less than the previous device, more storage (1,500 books rather than the current 200) and a speaker with a new function that reads the text aloud. Also, Stephen King’s new novella UR will be available exclusively on the new Kindle. The latest device costs the same as the old Kindle: $359.

The new "Text-to-Speech" audio function has raised some concern with the Authors Guild who stated that it must be considered an “audio right”, but Amazon said that customers would not confuse text reading with an audiobook. (Note: this is not the same as an audiobook where a professional talent is paid to read the story in a dramatic fashion.) I haven’t heard it but I assume it’s done using a synthesized voice perhaps like a dashboard GPS.

Another issue that was raised is the price of e-books for the Kindle: $9.99. Some publishers feel that the price is fine since they are investing in a lot in costly digital technology. And some say that e-books should not be considered of less value than the paper version and assume they would cost less.

With e-books being a very small (less than 1%) portion of book revenue, it would seem to me that having them at a reduced price would encourage buyers to venture into the e-book domain. But I’m sure that publishers don’t want to give up revenue in these hard economic conditions.

So, with the upcoming availability of the new Kindle 2, my questions are: Is it smart of Amazon to price the product the same as the older version? Or should it be priced cheaper than the 1.0 version even with the added features? And is $9.99 a fair price for e-books or should they be sold for less than say the mass market PB version of the same book?

It’s a Vision Thing

I stumbled across a few interesting articles this week, one in Time Magazine that asked, “What’s the Matter with Publishing?” and another on Shelf Awareness that offered a glimpse of Harper Collins Studio, a new division of the parent company. They serve as interesting counterparts to each other.books

Starting with the Time Magazine piece, I was surprised to learn that literary reading by adults has actually increased 3.5% since 2002, the first such jump in almost a quarter century. So, they postulate, the audience isn’t the problem. The trouble lies in the antiquated business model publishers have been following, which dates back to the Depression. Something like 40% of the books printed today are eventually pulped, which is not only environmentally criminal, but horribly costly for both publishers and stores. And an author who doesn’t sell through a certain percentage of their print run, in the age of computerized ordering systems, either must change their name or hope their publisher offers them another chance. And sadly, the latter doesn’t happen often. Bottom line is this is a business, dictated by numbers. No matter that the publisher printed far more copies of the book than you (or they) could hope to sell, especially if they didn’t back up that print run with marketing, which is generally the case. Authors have no say in how many copies of their book will be printed, making it a frequent topic of hushed conversations at conferences. Did you hear that John Doe had over 100,000 printed and barely sold 10,000? Or that Jane’s publisher printed so few copies she couldn’t get in any of the big box stores?

Actual print runs are a closely guarded secret, I haven’t encountered many authors willing to reveal their numbers. But we all live and die by those percentages. If you sell 5,000 copies of your debut, and your print run was 10,000, you’re in pretty good shape. Conversely, if your print run was 100,000, and you sold 20,000, good luck getting that next contract. It’s madness.

Which is what makes the Harper Studio model so intriguing. No more returns. And no big bidding: they cap their advances at $100,000 (although most Kindleauthors will probably get far less up front). What they do offer is more “creative” marketing assistance and higher royalty percentages (a 50/50 split-wow). And my favorite part: they’ve got a plan to encourage buyers to purchase ebook and audio formats of the same book for only a few extra dollars. Wherein lies the genius, in my opinion. Finally, a publisher that sees opportunity in the ebook format, and not just a threat. I love my Kindle, but it’s hardly ideal for the beach or baths. So how perfect would it be if I could start reading a book on my Kindle while waiting for a train, then continue reading at home in the tub that night, then listen to the conclusion in my car the next day? All for around what I would have paid for the hardcover version alone.

It’s an intriguing idea. I’m curious to see how it turns out. So far Harper Studio is apparently focusing on nonfiction, but if the model works, who knows? Maybe they’ll expand to fiction titles. Maybe more publishers will stick their toes in the water. In truth, anything would be better than how it is now, at least from the author’s point of view. In my experience you’re left with very little input into the production process and even less assistance on the sales and marketing end. It’s sort of the business equivalent of tossing a bird from the nest to see if they’ll fly, and sadly most authors end up plummeting to earth, their dream over before it even really began. And that is truly a shame. So I’m all for trying something new, adapting to the changing world and making sure that people continue to love and read stories. Because in the end, isn’t that what matters?

Catching the digital wave

Digital book sales, aka e-books, continue to soar.

According to the AP and other news reports, Random House has announced that they are digitizing thousands of additional books. Excerpts will be available online.

This move comes in the wake of the explosive growth of Amazon.com’s Kindle reader, which Oprah put on the map. I haven’t tried the Kindle yet, but if I’m lucky, maybe I’ll wind up on Santa’s list for it this year.

In general, it sounds like the heads of the book publishing industry must read the pixels on the wall and embrace ebooks, or risk becoming that industry’s next version of Detroit’s Big Three.

Of course, buried in the recent news reports about rise of e-books was the caveat that digital book sales represent only a thin slice of publishing’s pumpkin pie–estimated to be about one percent. But I’m old enough to remember when Japanese car makers had only a small piece of the American automobile market. Today, they’re cleaning our clock.

I do love the idea of being able to sample book excerpts and audio books online. That’s a powerful “sales lead-in” that’s going to encourage hard-core hardback book readers like me to jump aboard the e-book wagon.

I think it’s time for all of us to stop mourning the nongrowth of paper book sales, and celebrate the new digital age. It’s the future. Let’s embrace it. For example, last week when I posted, I was freaking out about the changes in the industry. This week, I have decided to reframe my thoughts about the book publishing crisis, and seek out the hidden opportunities in those changes.

Because ready or not, the digital era is here.
